Alaska Driving Under the Influence (DUI) Laws

In the State of Alaska it is illegal to drive with a Blood Alcohol Content (BAC) of .08 Percent or above. If you are a commercial driver it is illegal to drive with a BAC of .04 percent or above.

In either case you can be arresed for DUI however blood alcohol content is not the only criteria in which a driver may be arrested for driving under the influence. If a person mixes perscription or illegal drugs with alcohol or is impaired based soley on drug use the driver can still be arrested for DUI.

Driver License Revocation

If you are convicted of drunk driving in the State of Alaska you will have your driver license revoked for a period of time determined by the court.

To have a driver license reinstated after a drunk driving conviction the driver must provide proof of financial responsibility by submitting an SR22 Insurance form to the Department of Motor Vehicles.

Alaska DUI Test Refusal and Implied Consent

All drivers in the State of Alaska are deemed to have given their permission for a chemical test of blood, breath or urine to determine blood alcohol concentration. If an officer of the law suspects a driver of DUI a sample of the driver's breath, blood or urine may be requested to determine if drugs and / or alcohol are present.

If a driver refuses to provide this sample they will be charged with DUI and Refusal. These charges may be treated seperately and no "Work Only" driving will be allowed as a consequence of the test refusal.
