California Second DUI Penalties

For your Second Offense California DUI within ten (10) years of a prior DUI conviction, a Misdemeanor, you will face a jail sentence from 90 days up to one year, with a minimum of 48 hours to serve consecutively, but any sentenced jail time not served may be probated for a period of three to five years; a fine of at least $390 and up to $1,000; additional assessments totaling $1,000 or more; and a driver’s license suspension of up to 18 months.
Your vehicle may be impounded by the court, and yuou will have to pay to get it out when the impounded period ends.
 
You may be required to install an ignition interlock device on your vehicle.
 
In certain California counties, a pilot program requires you to install an ignition interlock device on your vehicle for a period of 5 months, if and when you are allowed to drive.  
 
On a second offense, a BAC test refusal adds 96 hours of jail time to your sentence, which must be served.
