First California Drunk Driving Conviction Penalties
For your First Offense California DUI, a Misdemeanor, without enhancement factors, you will face a jail sentence from 48 hours up to 6 months, with a minimum of 48 continuous hours to serve, but any sentenced jail time not served may be probated for a period of three to five years; a fine of at least $390 and up to $1,000; additional assessments totaling $1,000 or more; and a minimum driver’s license suspension of 6 months.
You must also attend 12 to 45 hours of DUI School.
Your vehicle may be impounded by the court, and you will have to pay to get it out when the impounded period ends.
You may be required to install an ignition interlock device (a device which takes a breath sample and prevents your car from starting, if you have been drinking) on your vehicle.
In certain California counties, a pilot program requires you to install an ignition interlock device on your vehicle for a period of 5 months, if and when you are allowed to drive.
With a BAC of 0.15 or more, or a refusal to take a BAC test, you may have to complete a 9-month DUI School program, and you may be ordered to install an ignition interlock device on your vehicle.
With a BAC of 0.20 or more, you’ll be ordered to complete an enhanced DUI treatment program, face a license suspension of 10 months, and you’ll be required to install an ignition interlock device on your vehicle.
If you were speeding at least 20 mph over the speed limit on a city street (or 30 mph on a highway), your minimum jail time goes up to 60 days.
A BAC test refusal increases your driver’s license suspension to one year.
For a first offense California DUI, a restricted driver’s license (hardship license) may be granted after your driver’s license has been suspended for one month.
