Florida DUI Consequences

Penalties for a First Florida DUI Offense

For your First Florida DUI Offense, a Misdemeanor, you will face up to 6 months of jail time (up to 9 months with a BAC of 0.15 or more or if you drive DUI with a minor passenger), but your jail time may be probated for a period of time up to one year; a fine of at least $500 and up to $1,000 (at least $1,000 and up to $2,000, with a high BAC or minor passenger); and a minimum driver’s license revocation of 180 days.

You must also attend 12 hours of DUI School; and be evaluated for an alcohol/substance abuse problem, following the recommendations from the evaluation. If you are allowed to drive, you must pay to equip your car with an ignition interlock device (a device that takes a breath sample from you and prevents your car from starting if you have any BAC), which must remain on your vehicle for a minimum of 6 months.

You will be on supervised probation for at least one year, and as one of the conditions, you must complete 50 hours of community service, and your vehicle must be immobilized or impounded for at least 10 days after you’re released. For undue hardship, the court can order you to pay a $10 fine for every hour of community service, instead of requiring you to perform the service.
