Penalties for a Second Florida DUI Offense

A Second Florida DUI Offense within five (5) years of a prior conviction is a Misdemeanor, carrying up to 9 months of jail time, but up to 12 months if you were DUI with a high BAC or minor passenger (you must serve a minimum of 10 days, at least 48 hours at a time, if your prior conviction was within 5 years); a fine of at least $1,000 and up to $2,000 (at least $2,000 and up to $4,000, with a BAC of 0.15 or more or a minor passenger); and a minimum driver’s license revocation of 180 days (but this goes way up, to a minimum 5 year revocation, if your prior DUI was within 5 years).

You must also complete 21 hours of DUI School; be evaluated for an alcohol/substance abuse problem, following the recommendations from the evaluation; and if you are allowed to drive with a restricted license, an ignition interlock device must remain on your vehicle for a minimum of one year.

If your second conviction was within 5 years of a prior DUI, your vehicle must be immobilized or impounded for a minimum period of 30 days, when you’re released from jail.
