Penalties for a Third Florida DUI Offense
A Third Florida DUI Offense within five (5) years of a prior conviction is a Misdemeanor, carrying up to 12 months of jail time; a fine of at least $2,000 and up to $5,000 (at least $4,000, with a BAC of 0.15 or more or a minor passenger); and a minimum driver’s license revocation of 180 days.
However, a third offense becomes a Third Degree Felony, if you had 2 prior DUI convictions within 10 years. You must serve a minimum of 30 days, at least 48 hours at a time, and your minimum driver’s license suspension will be ten years. Your vehicle must be immobilized or impounded for a minimum period of 90 days, when you’re released from jail.
In either case, you must also complete 21 hours of DUI School; be evaluated for an alcohol/substance abuse problem, following the recommendations from the evaluation; and if you are allowed to drive, an ignition interlock device must remain on your vehicle for a minimum of two years.
