Details: Penalties for a Second Oregon DUI Conviction
A Second Offense Oregon DUII within ten (10) years of a prior conviction is a Misdemeanor, carrying 8 to 30 days of jail time, plus mandatory probation for 24 to 36 months; a fine of at least $1,500 and up to $2,000; and a minimum driver’s license suspension of one year (but you will be suspended for three years if your second Oregon DUII offense occurs within 5 years of another one).
You must also attend undergo an alcohol/substance abuse evaluation; complete a recommended treatment program; and attend a victim impact panel.
You may request a hardship license after your license has been suspended for 90 days, but you must complete your treatment program before the hardship license is available, which may take longer than 90 days.
The court also has the option of suspending your registration for a period of up to 120 days or the option to order that your vehicle be immobilized or impounded for up to one year.
If you are allowed to drive, you must pay to equip your car with an ignition interlock device (a device that takes a breath sample from you and prevents your car from starting if you have any BAC), which must remain on your vehicle for an a minimum of one year; and you must make an SR-22 insurance filing with the state for a period of at least three years.
