Penalties for a Second Texas DUI Offense

A Second Offense Texas DWI, a Class A Misdemeanor, will get you mandatory county jail time of at least 30 days and as much as one year; a fine of up to $4,000; from 80 up to 200 hours of community service; and a minimum driver’s license suspension of at least 6 months and up to 2 years.

If you drive DWI with passengers under age 15, the range of county jail time rises to 180 days to two years, and the fine can go up to $10,000.

The state may also require installation of an ignition interlock device (a device that prevents you from driving with alcohol in your system) on your automobile, if you get a restricted license for essential needs, or when your license is reinstated.

You’re not eligible for a restricted license until after six months of suspension.

For a second offense DWI or later, the surcharge is $1,500 (or $2,000, if your BAC was 0.16 or more).
